Compensation Data

The Executive Director, Contract Compliance is responsible for protecting the assets of BI through compliant and accurate adjudication processes, as well as, to provide medium- and long-term strategic direction in the areas of contract terms, government policy and marketplace events. As a subject matter expert in Government pricing and policy, the position holder has in-depth knowledge for development of contract terms, disputes, audits, adjudication processes, and understand the interdependencies of Gov't policy and commercial contracts.  This role is responsible for leading, guiding and developing the Contract Compliance department.

The Executive Director, Contract Compliance is responsible for ensuring the accurate and timely payment of complex contractual rebate and charge-back obligations to managed care, institutional, retail and government customers, including PBMs, Plans, GPOs, LTC, Federal Supply Schedule, 340B and Medicaid, and execution of Managed Care audits. The position holder ensures all third-party vendors and systems meet the highest quality standards for payments, reporting and ongoing analytics. The incumbent is a primary contributor in collaboration with Contract Development, Payor Sales and Legal colleagues in ensuring clear and compliant language is included in all contracts we execute. This role develops processes and tools to track and report contract performance, managing disputes, and audits.

 

This office-based position is in Ridgefield, CT.

Duties & Responsibilities

  • Ensures contracted services are aligned with industry standards and comply with the government bona fide fee requirements.
  • Manages the assessment, processing and payment of all government and non-government rebates, chargebacks, fees and returns.
  • Ensures standardization of the process and compliance to relevant controls and policies.
  • Oversees financial validation controls prior to rebate payments.
  • Oversees and validates activities regarding evaluation, contracting, payment and reporting for the government contracts and filings, including but not limited to nFAMP, ASP, Tricare and BP. Requires a deep level of expertise to inform, advise, train and monitor the compliance of appropriate personnel regarding the Gov’t pricing policies, procedures and controls as they pertain to mandated requirements.
  • Manages all government inquires and audits. Keeps pace with potential policy changes and provides risk mitigation proposals.
  • Leads and influences to solve contract disputes and issues that arise with Key Account Management, Legal, and the Payor account (External).
  • Develops dispute and conflict resolution strategies and influences to gain consensus with BI Stakeholders and leadership.
  • Sets standards to create, refine and execute payment schedules to guide adherence and facilitate timely reporting to the US Government with respect to best-price implications.  
  • Develop, manage, monitor and analyze chargeback accruals and rebate accruals.
  • Innovates around best practices for 340B monitoring and crafting solutions to identify and report and limit duplicate discounting in all contracted channels.
  • Heavily involved in GTN process with respect to problem solving around duplicate discounting.
  • Improves GTN forecasting accuracy through chargeback analytics and appropriate accrual identification which is critical to the overall success of setting solid and defendable LTF forecasts.
  • Designs, develops and manages innovative rebate systems – that handle millions of transactions annually.
  • Ensures accuracy and completeness of data in the various systems for reporting.
  • Assesses feasibility of product and contract strategies and helps craft complex contract language to support BI position.
  • Ensures compliance with State and Federal regulations through the creation and execution of SOPs.
  • Charged with overall budget and cost center management.
  • Leads special projects related to impacts of Gov’t policy changes, process improvements.
  • Leads contact with internal/external auditors, as area has been identified as high financial risk due to the management of rebate and discount payments.  
  • Leads claims and charge-back analytics and assists with the development of user-friendly reports that allow colleagues across BI to understand how contract performance.
  • Utilizes analytics to generate insights into future contract strategies.
  • Assists with reporting on contract performance vs plan and previous forecast.
  • Acts independently with respect to resolving current business issues.
  • Strategically plans for future market evolution, industry landscape changes, gov’t policy proposals (impacts and risk mitigation at State and Federal levels).
  • Explores and builds mitigation strategies and adapt presentations to all levels in the organization.
  • Manages a team of 12-15 individuals.
  • Provides leadership, focuses on development and increasing communication and collaboration while ruthlessly prioritizing through market changes that affect this business.

Requirements

  • Bachelor’s degree required; MBA or other advanced degree preferred.
  • Requires ten plus (10+) years of relevant experience in the pharmaceutical industry. 
  • Five-plus (5+) years of experience creating contracting processes and policies, innovative contracting strategies, market channel net pricing policies, market access analytics (e.g. Gross to Net, rebates, chargebacks, etc.), and profitability for all US channels.
  • Five-plus (5+) years of experience in market access and / or trade, including contracting and negotiations.
  • Strong experience working with customers both internally and externally.
  • Ability to analyze, communicate and execute price and contracting strategies according to brand/portfolio objectives.
  • Strong project management, analytical thinking, and financial modeling skills.
  • Proven record of success in working with cross-functional teams; demonstrated ability to successfully educate and influence multiple levels of an organization.
  • Strong attention to detail combined with a keen ability to recognize issues in the context of higher-level policies and regulations (i.e., IRA, 340B).
  • Must have in-depth knowledge of all US price and reimbursement systems, channels, and payer needs
  • Strong leadership, planning and organization, analytics, decision-making, and problem-solving skills; focus on the delivery of results.
  • Strong interpersonal and peer leadership skills to influence without authority; ability to work cross-functionally in a highly dynamic environment with a high sense of urgency.

Leads the BI Contract Compliance processing and validation of payments which pertain to the following: 

  • Admin Fees; Purchase Based Rebates; Utilization Rebates (Managed Care rebates, Medicare Part D rebates, Medicaid rebates). These activities involve accuracy and technical expertise in interpreting complex contract terms and gov’t pricing rules and regulations. This involves the management of a staff of 12-15 individuals encompassing over 100 contractual agreements.
